Dua Zahra Case: Parents Granted Custody by the Court After 7 Months

The Sindh High Court heard the parents’ custody dispute in the case involving the alleged kidnapping of a young girl. During the hearing, Zaheer Ahmad’s attorney informed the court that the application was not allowed and that the judicial magistrate had previously rejected the one regarding the girl’s custody. He argued that the petition was still open with the trial court and that the petitioner still had the proper forum.

Furthermore, according to Zaheer Ahmad’s attorney, the petitioner should go before the trial court because the girl was taken to a shelter home on a court order and was not detained in custody. She served as the case’s primary witness, he continued. He said that after five meetings with the girl, the girl’s parents had asked the girl if she wanted to go home or not. In this instance, he said, Zaheer ought to be permitted to meet the girl as well.

The girl responded when Justice Iqbal Kalhoro summoned her, saying, “My name is Dua Zahra. I was in seventh grade in school. I want to go with my family which is present in the courtroom”.

When Zaheer’s attorney requested that the girl not be removed from the shelter, the judge said, “No one likes to leave their parent’s house, and our court is open to everyone. The girl is young and does not want to go to a shelter home.”

As a result, the judge rested the case in the parent’s favor while highlighting their responsibility to the girl. However, the decision about permanent guardianship would be made by the trial court.
